As the last interview for season 1 of Behind Justice, Cassie Interviews Fred from behind bars and two friends and advocates on the outside (Troy Allen and Terrill Robinson) about the injustice behind his case and how you can help.
Case summary: In October of 1982, a string of robberies and carjackings occurred in the Sacramento, California area. Just after one of the robberies occurred, 19-year-old Frederick Brinkley who had no criminal record and was known throughout the community as a straight laced family man with a young daughter happened to cross paths momentarily with a woman he did not know by the name of Irene Foster outside of a local store.
Police who were searching the area for the robbery suspect came across Freddie and Irene sitting together outside of the store and questioned them. After briefly questioning them, the police released them.
A week later on the morning of October 23rd, 1982, Freddie was arrested for the series of robberies and carjackings that had been occurring in the area.
Later on that same evening while Freddie was sitting inside a jail cell, another carjacking occurred and despite the physical impossibility of Freddie being able to commit this crime, he was charged with it anyway. And The woman he had briefly encountered the week before outside the store, Irene Foster, was charged as his co-defendant in the crime spree. While Fred and Irene were fighting the charges, the crime spree continued, but rather than re-evaluate their weak case against Freddie and Irene, the state pushed ahead with prosecuting them.
Despite no forensic evidence to link Freddie or Irene to the crimes, and Freddie having no prior criminal history, and even some of the victims testified in court that Freddie was NOT the man that had robbed them, Freddie and Irene were convicted of the string of crimes and given life sentences.
After Freddie and Irene were convicted, a well known criminal and gang member who had a long history of doing the same type of crimes that Freddie and Irene had been convicted of by the name of Jimmy Ray Smith, began to brag that he, his girlfriend Rene Owens, and their friend William Menefee had actually been the ones who had perpetrated the entire crime spree. At one point Freddie and Jimmy Ray found themselves incarcerated at the same facility and Jimmy Ray approached Freddie to gloat that Freddie was serving life for crimes that he (Jimmy Ray) had committed.
In the last several years, many people have come forward stating that Jimmy Ray had also confessed the crime to them, but that because of Jimmy Ray’s well known violent criminal history and membership in a notorious and violent gang, they had previously been too afraid to come forward with what they knew until after Jimmy Ray had died.
Freddie has been incarcerated over 39 years and counting. He was given a life sentence for crimes he maintains his innocence on and where there is no evidence link him to and where not a single victim was physically injured.
Freddie continues to be denied parole because still, after 39 years, he will not admit to the crimes he was convicted of. To add to this egregious injustice, Freddie’s daughter who was 3 years old when Freddie was convicted and sent to prison, was murdered by her boyfriend in 2005 when she was 23-years-old and her killer served only 18 years for her murder while Freddie continues to languish in a California prison almost 4 decades after he was convicted of crimes he did not do.

Summary: On July 16th 2007, cab driver Jose Roderiquez was shot and killed inside of his cab in Central Falls, Rhode Island on his 42nd birthday. The only eyewitness to that murder stated that she saw three men wearing hats flee from the inside of a cab and two of the people threw their hats as they ran off. In a lineup of suspects two days after the murder, this eyewitness identified two people (neither of which was Ezekiel), but despite her identification, these people were never prosecuted and the case went cold for over a decade.
Ezekiel Johnson Jr was 17 years old at the time the murder occurred and moved to Georgia shortly after the murder of one of his close friends (which occurred around the same time as the murder of Jose). Years after the murder of Jose Roderiquez, Ezekiel had moved back to Rhode Island, married his high school sweetheart and settled into family life. One day Ezekiel was subpoenaed to meet with prosecutor James Baum along with police detectives about possible information they believed Ezekiel may have about the death of a close friend of his. The prosecutor wanted Ezekiel to play the part of the state’s star witness in solving the murder of Ezekiel’s friend. Ezekiel stated that he could not help with the case because he did not have any inside knowledge about the death of his friend much to the clear frustration of prosecutor James Baum.
Seven months after Ezekiel was not able to offer the assistance the prosecutor and police wanted in solving that murder, Ezekiel was suddenly indicted on the cold case murder of Jose Roderiquez.
Two inmates who were serving time on unrelated convictions gave hearsay testimony to a grand jury claiming that they heard from other people that Ezekiel had committed the murder.These inmates were compensated for their hearsay testimony with immediate early release from their sentences. These hearsay testimonies were combined with additional and completely new testimony by the only eyewitness to the crime.
Originally the only eyewitness gave a very short statement to police about what she saw that night, which was 3 people run out of a cab and two threw their hats as they were running away from the cab, and all three people ran into a nearby house. 11 years later and the morning after meeting with prosecutor James Baum and police detectives, she then testifies to a lengthy, detailed, and elaborate story in front of the grand jury about what she saw that night, and the grand jury was never informed of her original statements or original identification of suspects and this second highly altered testimony was presented to the grand jury as if it was the original testimony and the grand jury never saw her original statements.
Even though this eyewitnesses testimony has suddenly become more detailed after 11 years had passed, she still was not able to identify Ezekiel as one of the people she saw that night and in fact, it was a month later at yet another hearing where Ezekiel is the only person sitting in the courtroom in handcuffs that she then identified him despite the fact that he looked nothing like the teenager he was at the time the murder occurred.
The hats thrown by two of the people fleeing the crime scene were tested in 2010 and no match with Ezekiel was found then, but after Ezekiel was unable to provide the state the testimony they wanted in the death of Ezekiel’s friend, the hats were retested and magically one of them came back with a partial match mixture, but even with that, the DNA analyst stated that the results were inconclusive and could not place Ezekiel at the crime scene.
Using hearsay testimony from active inmates who were granted early release in exchange for their testimony and changed testimony by the only eyewitness that was then presented as if it was the original testimony and a retesting of evidence that produced, at best, inconclusive results while ignoring earlier evidence that did not produce a match, Ezekiel was found guilty and sentenced to two life sentences plus an additional 10 years on a weapons charge although no gun was ever recovered from the crime scene.

Cassie interviews Juan’s wife Lisa as well as Juan from behind bars about his case.
Case summary: Late at night in May of 2013 in Pawtucket, Rhode Island, a home invasion occurred. Three people were inside the home that night, Jeffrey and Sherry LeBron and their teenage daughter, Sedina, Jeffrey LeBron was attacked and stabbed with a knife in multiple places on his body. His wife Sherry, and his stepdaughter, Sedina, were unharmed. After attacking Jeffrey, the assailants fled the scene, leaving behind a glove and a backpack of items.
Jeffrey described his assailant as two dark-skinned males, 5’6″ to 5’11”, who were dressed in all black clothing. A ways away from the crime scene, a friend of the victim’s, Juan Gibson, was walking home after his car had broken down. Police stopped him and questioned him about the home invasion. Finding that Juan did not match the description of either assailant, did not have any signs of having just stabbed and wrestled with someone, did not display any behavior consistent with having just fled a crime scene as a perpetrator and did not have any knowledge of a crime having just occurred, the police let Juan go on his way.
The morning following the home invasion, a couple who lived in the area close to the LeBrons called police to say they found a black sweatshirt in their yard and had thrown it over their fence into the street. The police sent the sweatshirt for DNA testing, and the sweatshirt came back having a partial mixture of DNA on a small area on the outside of the collar that was consistent with either Juan or male relative of Juan, and although the partial DNA mixture was only found in a small area outside the collar, police claimed that Juan had been wearing this sweatshirt during the encounter.
When the contents of the backpack that was left behind at the actual crime scene were first tested, the results did not suggest that Juan had been involved in the home invasion and the charges against Juan for this home invasion were eventually dropped due to such weak and speculative evidence.
A few months after the home invasion occurred, another incident occurred at that same residence. In July of 2013, another home invasion happened at the LeBron home and this time only Jeffrey LeBron and his teenage stepdaughter Sedina were home. This time, however, the incident turned deadly and Jeffrey LeBron was shot by the intruders. Jeffrey’s stepdaughter Sedina was once again unharmed. Sedina first told police that the assailant she saw was a tall, skinny, white male dressed in black. She repeatedly likened the assailant to the fictional character Slender Man.
With no evidence to pinpoint Jeffrey’s murder on anyone, the murder case of Jeffrey LeBron, as well as the earlier home invasion that occurred several months prior, went cold for nearly a decade. In that time, after becoming close with one of the police officers, Chip Devine, who was involved in the case, Jeffery’s stepdaughter Sedina changed her story to state that her stepfather’s assailant was a darker, light-skinned male rather than a white male that she had testified to earlier.
Although police already had Juan’s DNA in their database from him having a prior criminal record, after they dismissed the charges against Juan, these officers led by Chip Devine told Juan they needed a fresh DNA sample from him. Feeling as though he had nothing to hide, Juan gave the police a new sample of DNA, and shortly after giving police a fresh DNA sample, the police department decided to have all the evidence that had been collected from the first home invasion, such as the contents of the backpack retested.
Not surprisingly, evidence that had not previously connected Juan suddenly linked him to the first home invasion. In a desperate attempt to solve the cold case murder of Jeffrey LeBron, police simply relabeled evidence taken from the first home invasion and claimed it was new evidence in the cold case murder that had occurred months later and they got the case reopened, and Juan was indicted for both crimes.
Based on lies speculation and the testimony and sloppy laboratory procedures and analysis by Rhode Island State DNA expert Tamara Wong, who has previously been sued for misconduct and violating procedures that has led wrongful convictions before, Juan was convicted and sentenced to two life sentences plus 40 years in prison where he remains.
Chip Devine, the officer so instrumental in Juan’s charges and conviction, now works at the prison where Juan was sent to serve.

Host Cassie interviews Glen Johnson from behind bars on the details of his case and the injustice.
Summary: On September 20, 2002 Lamar Rufus was murdered by being shot in the head in the alleyway behind the Faststrip convenience store in Bakersfield, California. Two people were arrested and charged in connection with the death of Lamar Rufus – Arthur Lenix and Glenn Johnson, who is with us today.
Glenn Johnson was charged with being the get-away driver for Arthur Lenix. However, No physical evidence or security camera footage showed that either Glenn Johnson or Arthur Lenix was involved in the death of Lamar Rufus. A person who was with Lamar Rufus, Deshonte Grayson was also shot, but survived. Shockingly, he was never asked to identify his and Lamar’s perpetrator in a lineup of suspects or even called to testify about the ordeal during trial. The prosecution’s case relied entirely on the testimony of Lamar’s cousin Curtis Rufus who was supposedly present during the encounter, although no physical evidence or security camera footage indicates Curtis was there either. Glenn Johnson was found guilty at his first trial. However, on appeal it was discovered that the judge had influenced the jury and the conviction was overturned. The prosecution recharged Glenn a second time and he was once again convicted. During the appeal of that conviction, it was discovered that the state had intentionally withheld exculpatory evidence and Glenn’s conviction was overturned a second time. It was also discovered that two Bakersfield police officers instrumental in Glenn’s prosecution and conviction, were in fact operating a drug ring within the community of Bakersfield. The state, obviously unhappy with the two prior overturned convictions and likely embarrassed by their own officers misconduct, recharged Glenn a third time and he was convicted once again. As would be expected in such a weak case as the state had, Glenn was recently granted a new evidentiary hearing and hopes that justice will finally prevail in his case.

Cassie interviews Quindell from behind bars regarding his case and the injustice behind it.
Summary: On December 13th, 2012 Quindell Kirby was convicted of 2nd degree murder in the death of a cab driver that occurred in Richmond Virginia in 2011. Three eyewitnesses gave statements to police stating that they saw a white or Hispanic man fleeing the crime scene, despite Quindell not matching this description as he is a dark skinned African American man, he became the prime suspect in the homicide.
After learning of the murder, Quindell’s brother’s ex-girlfriend made unfounded claims that he was responsible for the crime and thus began Quindell’s legal nightmare that continues to this day.
Although over 23 pieces of evidence were collected from the crime scene, most of the evidence was not tested for DNA. In fact, the evidence that was tested was a swab collected from the inside front pockets of the victim’s jeans. That DNA sample, not surprisingly, produced inconclusive results. But because the results were inconclusive, the state maintained that it could not exclude the possibility of Quindell’s DNA being part of the mix and they pushed ahead with prosecuting him. Despite having over 20 other pieces of evidence that could have been tested, the state never bothered to test any of the other pieces of evidence such as the victim’s T-shirt that would have likely produced more conclusive results. Quindell was convicted and sentenced to 20 years in prison where he remains today.

In this episode Cassie interviews both David (behind bars) and his sister on the injustice behind his case.
Summary: In 1981, David Portee was charged with 21 criminal counts stemming from a series of rapes, kidnappings, and assaults that had occurred in the San Jose, California area. According to one police report, an eyewitness saw David’s car and license plate leaving the scene of an attempted kidnapping and police used this to indict David not only on this charge, but on 20 other charges as well. At trial the eyewitness identified in the police report testified that he never told police that he had seen David’s car or license plate leaving the scene and in fact, he could not make out any license plate at all. The officer who took that initial report however, did not testify himself and instead the prosecution put a different officer to testify in his place – an officer who could not testify about the accuracy of the report because he was not the one who had written it. During a physical lineup of suspects, not a single victim or eyewitness identified David as their perpetrator. Nevertheless, the state of California pushed ahead with prosecuting David with these crimes. And he was ultimately found guilty and sentenced to two life sentences plus 22 years and has been incarcerated 41 years and counting.
Although DNA testing was not yet available when David was charged, the judge ordered a semen sample collected from one of the victims to be preserved anyway. Just a few years after that court order was issued however, the same officers who were originally involved in charging David in the first place went against that court order and had the evidence destroyed in the early 90s.
In just the last few months, David received a letter from Santa Clara County Superior Court stating that no arrest record for David was ever issued in the first place, effectively making his detainment over the last 41 years, illegal.
Despite this, the state has not stepped up to help David’s wrongful imprisonment. David is seeking legal help to finally get justice he has been denied for over 4 decades and welcomes anyone who may be able to help him to reach out to him at the address provided.

Cassie interviews Chiron, who is behind bars, to go over his case and the miscarriage of justice regarding his case.
Summary of the case: In 2017, Chiron Francis was convicted of a double homicide that occurred in Houston, Texas in 1994 despite no forensic evidence or eyewitness statements linking him to the crime, in fact at trial the eyewitnesses stated that Chiron was NOT the person they saw at the crime scene.
On the afternoon of April 11, 1994, the bodies of Douglas Schwartz and Eric Heidbreeder were found in Douglas’s car in a residential neighborhood in Houston, Texas. Each had been shot three times in the head at nearly point blank range. Witnesses who called 911 stated they saw a light skinned black or hispanic man 5’8” to 5’10” leaning into the passenger’s side window and then fleeing the scene on foot.
Nearly 6 months after the crime occurred, a former high school associate of Chiron’s by the name of Ray was originally named as a suspect and brought in for questioning. Motivated to save his own skin and also by the offering of $13k in reward money for information leading to an arrest in the case, Ray claimed that Chiron had confessed to the crime to him, however Police never attempted to locate or question Chiron at the time. 20 years later, with no new evidence or eyewitness statements, police indicted Chiron on the murders while he was living aboard in Venezuela and had him extradited back to the US to face charges. With no forensic evidence, contradictory police statements, suppressed crime scene evidence,and a simply impossible theory of the case by the prosecution, Chiron was found guilty of the murders and sentenced to two 75 year terms in prison where he remains today.

Cassie interviews Albert from behind bars on his case and how you can be able to help him get justice.
Summary of the case:
On July 12, 1979 16-year-old Albert “Scot” Wooldridge and his 13-year-old cousin Jamie Jones met up at the Westgate Mall in Abilene, Texas. Jamie has asked Scot to help her run away from home and he arranged to have some friends come pick her up at a popular swimming hole alongside the busy Winter’s freeway. While they waited for her ride at the swimming hole, Scot and Jamie smoked both marijuana and PCP and drifted into a hallucination-induced alternate reality.
When Scot came to, he discovered Jamie laying at his feet as he stood over her holding a stick. When Scot was questioned by police, without his parents or attorney present, he told them all that he remembered of what occurred that day. The police type up what he believed was what he told them. They told him if he signed the papers, he would be released to family. At 16, Scot was illiterate and functioned at a much lower mental level than his age and could not verify what the statements actually said, but in his own words, he always believed that “the cops were the people you could trust”, so he signed the statements believing that they were accurate to what he told police. A few days later, the police told him they lost the first statement and needed him to sign another one. Again, without his parents or attorney present, Scot signed the papers without being able to read them. The statements turned out to be two differing and contradictory “confessions” that stated Scot had lured his cousin to the swimming hole in order to rape and murder her. Scot was charged with Capital Murder and based on the statements the police had him sign, he was convicted and sentenced to life in prison. His defense attorney never called Scot to the stand and did not call anyone else in his defense. After 43 years, Scot continues to remain incarcerated for the unintentional death of his cousin that occurred when he was 16 and he is looking for legal help to assist him with any type of post-conviction relief. Host Cassie interviews both Daniel and his wife Tracy on the injustice behind his case.
Case summary:
On February 18, 2006 Daniel Simms, who was struggling with substance abuse issues went to a local drug dealer’s house. Later that evening when Police arrived after receiving a disturbance call, Daniel was found with severe injuries to his head stemming from being beaten with a hammer and a dumbbell by the occupants of the house. The occupants of the house claim that Daniel attempted to rob them at gunpoint and they beat him in defense.
The State charged Simms with one count of robbery in the first degree, two counts of assault in the second degree, and unlawful possession of a firearm in the first degree. The state also charged Simms with firearm enhancements for the robbery and assault counts.
At trial, the residents he was accused of robbing at gunpoint did not show up even after they were subpoenaed to testify and in their place other residents of the house testified and all had varying and often contradictory stories about what happened that night.
Because Simms had been convicted of assault in the second degree with a firearm enhancement in 2000, the court doubled the firearm enhancement, adding 22 years. So what would have been a 12 year and 9 month sentence, then turned into a 34 year and 9 month sentence for that simple fact.

Cassie sits down with Eddie’s sister to talk about his case and the injustice behind it.
Summary of the case:
In the early morning hours of April 8, 2016 the badly beaten and unconscious body of 33-year-old Luis Sedillo was found outside his apartment complex. He never regained consciousness and died just a week later. 24-year-old Eddie Carbon had been playing video games with Sedillo in his apartment earlier in the evening by both his own admission and by the witness statements of three other people who were in the apartment with Eddie and Sedille at that time. Eddie claims that he left his apartment after playing video games and went to another apartment where he was staying in the same complex. DNA collected from the murder weapon found DNA from at least two individuals, and entirely excluded Eddie Carbon. Additionally, all other DNA that was collected from the crime scene including DNA from the victim’s clothes ALL excluded Eddie Carbon entirely. Eddie initially fought the charges, but just before trial, he was scared into taking a 30-year-plea deal because the prosecution decided to seek the death penalty against Eddie if he went to trial and lost. Despite having a weak case with no forensic evidence to support the charges against Eddie, the prosecution and even Eddie’s own defense attorney exploited his low IQ and mental health struggles to get the case wrapped up and put to bed.
Eddie was granted an appeal by the courts (unusual for a person who took a plea deal) and he is currently working pro se to seek a reversal of his pressured plea.

Cassie talks to Brian’s family about the injustice he is facing in his case.
Case Summary:
Brian Griffin was accused of sex abuse of his former girlfriend’s daughter. The girl’s mother videotaped her daughter making the allegations against Brian and submitted them to the police. The police requested multiple times that the daughter make a statement directly to police both with and without her mother present as is standard procedure, but her mother refused to let her daughter be questioned or give statements to police directly about the allegations. The girl claimed that Brian had videotaped the abuse on his cell phone and had also taken pictures of the abuse. Police confiscated Brian’s cellphones and used their software Cell-Brite which can even search through data that has been deleted from a device and they found none of the footage the girl (through her mother) claimed existed on the phone. Under pressure by Brian’s ex-girlfriend, the police went ahead with prosecuting Brian for sex crimes despite finding no evidence of the abuse.
Shortly after Brian was sentenced to 15 years in prison for the crimes, the alleged victim then recanted on a recorded line and admitted that she made everything up and she was pressured by her mother to make such allegations against Brian because her mother was mad at Brian for breaking up with her after she (the mother) had stabbed him during an argument.
Brian continues to maintain that he is innocent.

Host Cassie interviews the family of Carl Robinson and shares the miscarriage of justice which landed Carl in prison and how he is fighting for his life to prove his innocence.
Summary of the case:
In the late evening hours of August 16, 2007 Jessica Quintana was sitting behind the wheel of her boyfriend’s car while her brother Jonathan Quintana sat in the back passenger seat as they waited for her boyfriend Diego Perez outside the house he shared with his sister. As soon as Diego got into the passenger seat of the car, they heard the sound of gunshots and breaking glass. Fearing for their lives, Jessica ducked down and pressed on the accelerator while Diego leaned over to steer the car. Jonathan, sitting in the rear passenger seat, looked back but could not describe or identify any shooter. They continued to hear shots being fired from behind them as they sped away.
Despite none of the victims ever getting a visual on any shooter or anyone else in the area getting a visual on the shooter, two local people named Carl Robinson and Donte Moreland were picked up and charged with 3 counts of premediated murder and of firing at an occupied vehicle. Nothing connected Carl to the shooting, no DNA, no fingerprints, no gun, no gang affiliation, no prior criminal record, and no eyewitness statements.
His first trial ended in a mistrial due to a deadlocked jury. Carl was tried again and this time the prosecutor himself stated hearsay testimony and the judge not only allowed this hearsay testimony by the prosecutor to be admitted, but the judge also wouldn’t allow the defense to put the prosecutor on the stand in order to impeach his testimony. Based on that hearsay evidence by the prosecutor, Carl Robinson, despite having no prior criminal history or gang affiliation, was convicted of 3 counts of premediated attempted murder and shooting at an occupied vehicle. He was sentenced to 110 years in prison where he sits to this day.

Our host Cassie sits down with Randy’s mom Veronica to discuss the injustice behind his case.
Summary of the case:
In late November of 2010, Randy Rickards was arrested for participating in two different armed robberies over two days in Newport New, Virginia. In the first robbery, the three victims testified that it was too dark to make out any identifying features of the robberies other than race. The robbers also wore hoods obscuring their faces. However, due to suggestive tactics used by police, two of the three victims identified Randy from a photo line-up. The following evening, Randy, an acquaintance and two other people pulled up to two individuals in a convenience store parking lot to ask for cigarettes. In a sudden turn of events, the driver of the car (Minello) got out of the car, pulled out a gun (which turned out later to be fake) and told the two people to empty their pockets. Randy stayed in the passenger seat of the car and maintains that he did not know that Minello was going to rob the people and that he never participated in the robbery. Minello and Randy were both arrested and charged with armed robbery. At trial the victims maintained that Randy had remained in the passenger seat and did not have the gun. Further, the victims testified that Randy had told Minello to give them their wallets back. DNA collected from the fake gun showed Randy had never touched the gun, but the jury was not shown a copy of the forensics report. The jury found both Randy and Minello guilty of the armed robbery. Originally, the jury sentenced Randy to a 6 year prison sentence, but before the sentence could be imposed, the judge sent the jury back reminding them of Virginia’s mandatory minimum sentencing laws and when the jury came back a second time using the sentencing guidelines put into place by mandatory minimum sentencing, the jury was forced to sentence Randy to 41 years in prison for simply being in the wrong place at the wrong time when a person he was with decided to commit a robbery.
A crowdfunding site is currently being constructed to obtain legal help to try to get Randy resentenced to a more reasonable term.

Summary of the case: On June 14, 2010 Jessy Zachary and Jason Lee Mock attempted to steal a truck outside a residence in Houston, Texas. Jason told Jessy that he knew no one was home because he (Jason) used to live nearby. Jason entered the home through a window. Jessy stayed outside waiting for Jason to get the keys to the truck. Jessy heard a commotion from inside the house. He heard Jason shout from inside “Don’t look at me, Don’t look at my face”. Confused as he thought no one was home, Jessy looked through the window and saw Jason cut the throat of 78-year-old Mable Cleveland with a knife. Jason and Jessy fled the scene. Jason was arrested two weeks later. Jason told the police that Jessy had been the killer and despite no DNA evidence or fingerprint evidence that confirmed this statement, Jessy was arrested the day after Jason and charged with Capital Murder where Jason was only charged with Burglary of a Habitation. Jessy was not informed of the evidence that exonerated him and he was told by his lawyer that if he continued to fight the murder charge, he could be sentenced to life without parole or the death penalty if he went to trial. Terrified of either result, Jessy took a plea deal for 40 years for the murder of Ms. Cleveland. Jason Lee Mock, whose DNA, fingerprints, and bloody shoe prints were found all over the crime scene, was sentenced to 17 years for burglary, but only served less than a handful of years and currently walks free, while Jessy continues to languish in a Texas prison.

In this episode Tremayne Willis interviews Eric Smith’s sister on his case.
This is the case of Eric Smith, a young man, who in the 90’s, (along with 6 others) was convicted of a double homicide. He was subsequently released for 7 months due to perjured testimony and other factors. Unfortunately, even though the factors remained the same, his freedom through the court was short lived as he is still in prison to this day. Eric, as well as his family, friends and attorney maintain his innocence. They feel that this conviction was simply derived from a system that is not only BROKEN, but, at its core; CORRUPT. {Especially, for a man who wasn’t even present when the crime took place!}

In this episode of Behind Justice, Cassie speaks to Joel’s Mother and a cop who knows his case and is speaking out about it.
Summary of the case: On April 25th, 2009 in Erie, Pennsylvania 22-year-old Joel Atkin was driving to visit his mother. After turning onto a side street, he was stopped by a group of people blocking the road in the midst of a party. Jayson Sack approached the drivers door, opened it and physically assaulted and forcibly pulled Joel from his car, Jayson was both drunk and high on hydrocodone at recreational levels. Joel attempted to, and was successful in, pushing Jayson off of him temporarily, but in response to being pushed, Jayson pulled out a knife. In an attempt to control the threat that Jayson posed, Joel pulled out his legal concealed carry firearm with one hand, pointed it at Jayson and told him to “don’t come any closer” while using his other hand to call 911 for police assistance. Jayson, refusing to heed Joel’s warning, attacked Joel again, during the scuffle, Jayson was able to get Joel into a head lock and attempted to strangle him. Joel, still on the phone with 911 and now unable to flee and fearing for his life, fired his gun. The single bullet that was fired from the gun hit Jayson in the lower right abdomen, killing him. Joel was arrested and charged with the murder of Jayson Sack by an Erie Police Officer who was cousins with the deceased. A video of the incident was confiscated at the scene by police to be taken into evidence, but then was “lost” and never logged into the evidence room. Additionally, 32 seconds of the 911 call Joel made where he stated that Jayson had a knife and requested an ambulance was also cut out and never played for the jury. The jury convicted Joel based on an incomplete picture, as nearly all exonerating evidence was not shown to the jury. Joel is currently serving 17-34 years in prison for defending himself against the violent attack of Jayson Sack.

In part I of the Quincy Cross story Cassie speaks to both Quincy’s father and the father of the murdered daughter Jessica.
Summary of the case: In the summer of 2000, 18-year-old Jessica Currin was found murdered in the small town of Mayfield, Kentucky. Two suspects were initially charged in connection with her death; however, those charges were dropped after the local DA lost the evidence against them. Several years later and after mounting public pressure to solve the case, police charged a new group of people based on allegations of three local Mayfield girls who said they had witnessed the crime. The new group of suspects included a young man named Quincy Cross who was not from the area. Although Cross had not even met one of his co-defendants until two years after the murder occurred. To this day he has still never met his other co-defendants, yet he was convicted of Jessica’s death based solely on the testimony of the the three local girls who then later recanted their stories stating that they had made up the stories due to the combination of police pressure and the lure of reward money. Despite no forensic evidence to link him to the crime and the fact that he still has never met some of his co-defendants, Quincy Cross was sentenced to three life sentences without the possibility of parole and remains wrongfully incarcerated to this day. Both Quincy’s family and Jessica’s family believe that Quincy was wrongfully convicted, and that Jessica’s real killer or killers have not been brought to justice. The Kentucky Innocence Project has taken up Quincy’s case, but as his case works its way through the slow process of courts, Quincy continues to suffer in prison while the real perpetrator(s) of this horrific crime have not been brought to justice.
